These terms and conditions are applicable to the website “www.gaurdiagaming.com” and any related projects involved with it. This website is operated and maintained by Mr. D. Fricia.
The web hosting package is paid for and registered by Mr. D. Frica Junior, the owner of Gaurdia Gaming and Return to Gaurdia (RTG).
The game client is a modified version of the First Star Online game engine, which was created by Unfungames. All modifacations or game scripts added were created by Mr. D. Firica Junior unless otherwise mentioned.
Property
You hereby acknowledge that Gaurdia Gaming owns all intellectual property rights of the content on this web site, including all material associated with: Return to Gaurdia. You may not use this material except if explicitly mentioned in these terms and conditions.
The software, documentation and any fonts accompanying this License whether on disk, in read only memory, on any other media or in any other form are licensed, not sold, to you by Gaurdia Gaming for use only under the terms of this License.
Gaurdia Gaming reserves all rights not explicitly granted to you. The terms of this License will govern any software upgrades provided by Gaurdia Gaming unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.
Permitted License Uses and Restrictions
This License allows you to install and use one copy of Gaurdia Gaming software on a single computer at a time. This License does not allow you to make the software available over a network where it could be used by multiple computers at the same time. You may not copy, decompile, reverse engineer, disassemble, modify, or create derivative works of the software.
Transfer
You may not rent, lease, lend or sublicense the Gaurdia Gaming software.
Termination
This License is effective until terminated. Your rights under this License will terminate automatically without notice from Gaurdia Gaming if you fail to comply with any term(s) of this License. Upon the termination of this License, you shall cease all use of the software and destroy all copies, full or partial.
Return to Gaurdia Game Server
To play the game you do require to choose a Username and a Password to get access and to play. When registering to the game the first time, you will receive a virtual representation within the game, hereafter referred to as "character" or "account". The Username and Password are also required to use certain functionality on website and forums.
Server Rules
To play Return to Gaurdia, you must agree to and abide by the following server rules:
- No questionable characters names.
- Anyone who abuses/harasses a member of the community will be permanently banned from the game.
- Purposely circumventing the profanity filter to harass users that have it turned on will be considered harassment if proof is presented.
- The staff is very busy so if you have any questions consider if it can be asked on the forums first. We don't have time to answer the same questions over and over again.
- Do not annoy admins. Don't ask to be mapper, admin or moderator. If you want to apply please use the Staff Applications section on the forums.
- Do not bug admins. If you ask an admin a question, and they do not respond back, then they are busy doing something.
- Never ask admins to help you with game play.
- Stealing items or scamming another character is not tolerated.
- Do not ask admins for items. Admins are on the server to help players, map or run events. They are not there to give you free stuff.
- You may not modify the Return to Gaurdia software in anyway. This is hacking, and will be permanently banned from the server. We may pursue legal recourse if any of our property (including servers, scripts, files, programs, etc) is damaged by you or your attempts.
- You may not exploit any bugs in the Return to Gaurdia client/server to your advantage. We want everyone to have an equal chance. Anyone found to be exploiting know bugs will be banned. If you do find a bug mail a description to an admin.
- Don't macro and don't tape down the tab key in any way. If you break this rule you will risk losing all your items or even your account.
- The selling of items or accounts for real money is strictly prohibited.
- Don't give your password to anyone else. We are not responsible for possible damage to your account if you do.
- We reserve to right to deny access to our game/site/forums when we feel that any of the above rules are violated.
Username
You must not choose a Username that infringes the rights of any third party or other users, or which is deliberately confusing or which is offensive, racist, obscene or otherwise unlawful. We reserve the right to ban any Username for any reason.
Password
You agree to keep your Password safe at all times and not to disclose it to any other person. You must ensure that your computer is kept free of viruses and Trojans to ensure the safety of your password. Real Return to Gaurdia staff will never ask you for your current password.
You must inform an administrator immediately in case your password comes to the notice of someone other than yourself, or in case you have received aforementioned password from someone other than Return to Gaurdia. All use of our services after valid identification with your password is considered to have been initiated by you. In case there is cause to believe the site's safety has been endangered, Gaurdia Gaming reserves the right to change your password.
Return to Gaurdia Account
You agree that your Return to Gaurdia character, account and items are and remain the property of Gaurdia Gaming. You may not sell, transfer or lend your account to anyone else, or permit anyone else to use your account; you also may not accept an account which anybody else offers you. We reserve the right to delete all your accounts, block your access to our website and services, and/or take further legal action if you violate any of these terms and conditions. We may delete or modify any account at any time for any reason.
Sign-Up
By signing-up for an account you are opting-in to allow us to store personal information, cookies, etc. as described in our Privacy Policy.
Subscription/Payments
Return to Gaurdia does not require a subscription or payment when creating a character. Return to Gaurdia will remain as a free-to-play game as long as it is open.
Correct Behaviour
Especially, you must not use the chat/forums facility to harass, threaten, scam or deceive other players. You agree that the chat facility is only for role-playing in the game, and is not designed or intended to be used as a forum for other types of discussion. You must not use the chat/forums facility to advertise other websites or products.
You agree that for the purpose of preventing offensive language and cheating we may automatically or manually censor the chat as we see fit, and that we may record or monitor the chat and forums to help us identify offenders. Sexually harassing, threatening, stalking or otherwise harassing others may result in legal action being taken against you.
If you are the victim of the sort of behaviour described above, or receive any other unwanted communications you can report this to our game staff. You are welcome to contact them in the game itself, or by email, which can be obtained on the forums.
We will inform the competent authorities about any illegal activity of information given or registered on the site.
Cheating
You must not exploit any cheats or errors which you find in our game. Any cheats or errors which you discover must be reported immediately to us.
You must not attempt to use other programs in conjunction with Return to Gaurdia to give yourself an unfair advantage. You may not use any bots or macros to control your character for you. When you are not playing the Game you must logout. You may not circumvent any of our mechanisms designed to logout inactive users automatically.
You must not misuse any of our customer service facilities. You must not deliberately enter false information and/or scripts into any of the forms on our website, or in our games. You must not encourage, or attempt to trick other players into breaking our rules.
Provision of Service
You must not reverse-engineer, decompile or modify the Return to Gaurdia client in any way. You must not use a modified/customised version of the Return to Gaurdia client. You must not create or provide any other means by which any of the Games provided by this website may be played by others (including, without limitation, replacement or modified client/server software, server emulators).
Submission of Content
Occasionally we may accept ideas and game additions that are submitted by users. You agree that by submitting material for inclusion in Return to Gaurdia you are giving us a non-exclusive, perpetual, worldwide, royalty-free license to use and/or modify the submitted material as we see fit. You agree that you will not withdraw the submission or attempt to make a charge for its use. Furthermore you warrant that you are the exclusive copyright holder of the submission, and that the submission in no way violates any other person or entity's rights.
Privacy
The only personal information we collect about you is information which you provide via forms on our website or the game client.
No personal information is collected when you access the public areas of our website.
To play our multiplayer online games you will need to create an account and provide a username, password and email address.
Cookies
This website uses cookies to track your country (to enable locale enhanced information) and to track where you entered our site from. We use cookies, ip-addresses, and other unique identifiers in order to identify specific computers that access our services. We generate and store logs indicating usage of our site and activity in our games. We store 'save game' and 'game settings' information to enable us to provide a better games service in which your activities and achievements are remembered in the game.

Availability
We will make reasonable commercial efforts to ensure that this web site / Game is available 24 hours per day without any interruptions. However, we reserve the right to make this website and/or Game unavailable at any time or to restrict access to parts or all of this website / Game without notice.
Cancellation of Account
We reserve the right to cancel your account at any time with immediate effect if you breach any of these terms and conditions, or our Rules of Conduct.
Changes to these Terms and Conditions
Any variations to these terms and conditions shall be inapplicable unless agreed in writing by Gaurdia Gaming. Applicable Law
Nothing in these terms and conditions affects your statutory rights as a consumer. These terms and conditions are governed by Australian law and any dispute connected with this is subject to the exclusive jurisdiction of the Australian courts.
